What are my legal rights regarding faulty computer software?


I brought Antivirus/Firewall software & ever since installing the Laptop crashed & rebooted itself
The frequency of this varied, sometimes worked for 12 hours, other times rebooted 8+ times in 20minutes!
Supplier said 'they only sell the software' & 'to talk to the distributor', who claimed it was a 'common problem' that would be fixed by uninstalling & reinstalling it, making sure it fully updates.
Did this 4 times it still occurred so they told me to contact the Software Development Company, who told me they have 'never had the problem before' then almost instantly sent a step by step solution
Tried that twice, no success so they suggested repeating it in safe mode & only partially reinstalling again in safe mode, tried 3 times
This still did not resolve the problem
The supplier is now offering a refund but what about compensation for the inconvenience that this has caused
I have lost several days working time due to this, numerous files & a client, due to delays this caused

If its not working correctly take it back for your money or an exchange (Sale of Goods Act).

Your contract is with the shop not the manufacturers (Donogue v Stevenson 1932).

Makes me very lived that shop keeps do not know the law and they trade!

Take the money and run, its not worth the hassle

If you read the license, you'll see that the software company is not liable for incidental damages. If you lost files, you didn't follow the standard recomendation of backing up your files. That's not their fault.

If you lost a client due to delays, could not having prioritized your work have prevented that?

With the many different types of software out there, it would be difficult to prove that the anti-virus software was the sole reason for your difficulties. Was the computer free from viruses when you installed the anti-virus software? Was the computer in a standard configuration, or did you have lots of other software installed. How do you know that another software package might not have been interfering with the anti-virus software?

It is impossible for a software company to insure that their product will operate with EVERY OTHER software package ever created. Many programs install their own DLL's and other bits of code. You may simply have a bit of incompatible software, or some combination of software that simply won't allow the antivirus program to function properly. The software company would only be liable for a defective disk, and then, only for it's replacement; not for your woes.

The only legal liability with software is to change faulty goods like for like ..... you can blame software pirates for that ....

File a case against the supplier and software owner to compensate you with the amount of the product, the cost of the working time you lost and the moral damages you suffered.
