How should the profits be split on a two way real estate investment?


Investor 1- Lives out of state
took out $129,000 for the loan and rehab.
$94,000 mortgage
$30,000 loan
$5,000 in payments on the mortgage and other costs
No labor on rehab
No research

Investor 2&3- Married Couple
Put up the 5,000 at the courthouse when bidding on the foreclosure day of auction. Sale price 99,000
- Project Managers:
Researched foreclosure MIE list previous to the sale to find the best investment
bid and won property at auction
researched best loan
90% of rehab
10% subbed out- researched and found best contractors for each job
researched and found best attorney for closing
Managed property from closing to sale
Investor 3 is a Reator and listed property for 0 commission on her end.

Basically Investor 1 put up most of the money but did nothing else
Investor 2&3 Made it happen

Split the profit 50/50. Investor 1 took all the risk, and made it happen from a financial standpoint. Next time agree on how the profit will be split ahead of time, and have a lawyer write up a contract for a few hundred dollars.

This is the question that should have been asked up front, before the purchase. Otherwise there might be a disagreement in who pays and receives what.

It sounds to me as if 1 bought the house and 2/3 acted as Realtor/property manager.

How much does a property manager get and how much does the Realtor get. Usually a small percentage.

If I put up the money for a house, it is my house.

I think it will be good to split profits 50/50 . However next time these things should be pre determined. i opened my site www.forallhouses.info and split 30/70 but it is all legal.

This really, really, really should've been figured out and written down before the transaction happened, but you live and learn. Anyhow, as things now sit I'd suggest just spliting everything 50/50. Of course first off pay off everyone for all money they put into the deal (possibly also pay investors 2&3 something for the extra time they put in). Then just split whatever is left over 50/50. If title is held jointly between the 3 people then you cold make a case for 1/3rd for #1 and 2/3rds for 2 & 3; since this is apparently how a court would divide the money.

Anyhow, it is somewhat negotiable but try to keep everyone happy (or at least satisfied) so you can do another of these deals down the road.
