Can I register and get a new title with this situation?


Here is the situation that I have: (I will use fictional names to explain it).

1. The front page of the title has John Doe as owner.

2. On the back John Doe signed over the title to John Smith who signed as John smith as the buyer.

3. John smith never got the title in his name, instead using the same title he signed it over to Chris Webb.

4. Chris Webb never had the title put in his name neithr, but with the same title he wants to sign it over to me.

Is this legally possible? Will I be able to register and transfer the title in my name having all these transfers appeared on the title. It looks like it can be done because they have 4 different spaces where the owner can sign it over to the buyer. But what I don't know if those 4 spaces are for the original buyer, and they simply have it there in the event that a mistake was made. Someone with knowledge with this please help me.

On a title usually a individual can only sell it once. On a Kansas title there is one place for a private party to sign and sell. The other 2 spots are for a dealer to sell to other dealer or other person not individuals to individuals. If a private party does this it is called title jumping and is illegal .The may not even belong to the people who have sold in the past.You cannot take whiteout and just change anything you want on a title. If you buy it as it is you may loose your money and the car. The reason each person is to register is so the paperwork can be correct and each person pays tax on it. I would run away from this deal no matter how good it looks because you may loose it all. If you don't believe me call the DMV and ask before you buy it or pay for it they will tell the same thing or something close.

Unless John Smith is a dealer, he can't sign the title over without titling it himself.

Chris won't be able to sign it over to you, either.

All those spaces, are for DEALER transfers. And each dealer has to attach a form.

Don't try to buy this car. It will be a PITB to get it registered.

Since none of the transfers were ever recorded, just complete the transfer as though you were the first. If the title is physically damaged so you can't write on it (or run out of space), there are two ways to go:

1. get a replacement title issued from the DMV (which would be sent to John Doe).

2. use whiteout to make the form useable again.

Go into the DMV and ask them to complete the transfer. If they can't use your form, they may have a substitute form. As long as the vehicle is not stolen and has no liens, you should be able to register it.
