Which laws apply?


I am designing a Web site for a client. Since I (the designer) live in Texas and the client is in California and I'll be designing (and updating) the site in Texas, I'm assuming the statues of the State of Texas apply. Is this correct? Or do both the statues of California's & Texas's apply?

Client: California
Design/Creation: Texas
Hosting: California
Maintenance/Updates: Texas

Please let me know which staue statues apply, California's or Texas's. Since the Web site will be designed in the state of Texas, I'm thinking the following "Business & Commerce Code" statues of the State of Texas apply:

Chapter 43. Uniform electronic transactions act
Chapter 46. Electronic mail solicitation
Chapter 48. Unauthorized use of identifying information

Please let me know which laws/statues apply?

I'm still writing the contract. No it has not been signed yet. I'm still going to meet with my client. It will most likely be signed in California.

What State did you stipulate governs in your written contract between the client and yourself. Where was this web design contract executed (signed)? In lieu of failure to have a specific ruling state clause will normally fall where the client resides which in this case is California. And is there an arbitration clause in case of a dispute and where is the AAA located? Texas or California? The AAA's State location should be the same for where the contract is executed.
