How do you deal with an FBI investigation?


My husband from Saudi Arabia, was arrested 2 months ago because he bought a small handgun 2 years ago when he was technically illegal. Now the FBI agent has dug into his history and brought up every financial transaction, all business dealings and even consulted my old company for negative information on my husband. This agent won't go away and he acts as though he is onto some terrorism case. They have offered to let my husband out of jail and be deported (how nice of them) if he agrees to a "debriefing" and the debriefing must be acceptable to the agent. Any suggestions?

There's only one thing to do: hire the ACLU.

If you have not already done so, your husband must talk to a lawyer about his situation. Immediately. The lawyer should be knowledgeable about both criminal and immigration law. He should explore all options with the lawyer. Normally every citizen is protected by 5th amendment rights against self-incrimination, but your husband's status as a citizen, permanent resident or other form of immigrant places him in jeopardy. The FBI has made huge blunders in the past including Ruby Ridge, Waco, Texas, Richard Jewell from the Atlanta Olympics, the anthrax investigation among others. Do not let your husband become the next victim. Talk to a lawyer specializing in immigration and criminal law ASAP.

I am sorry to hear about your situation, but why did he buy the gun? If he is now legal and they have no proof just answer their questions and everything should be alright. If when they dug into his past they found questionable things in his past maybe you should speak to the agent. Not saying that he has done anything wrong, but he wouldn't be the first man to tell a lie about his past.

I recommend that you interview at least three attorneys who have experience in Criminal Defense and at least three attorneys who have experience in immigration law.

I recommend that you ask them about their experience at trial and about the cases that they have won and lost.

I recommend that you hire a Criminal Defense attorney who has good trial experience and a good record at winning cases.

I recommend that you also hire an attorney who specializes in immigration law and has a record of winning immigration cases.

I doubt that you will find an atorney who has a good record at both Crimianl Defense and Immigration law.

I would go with two attorneys and have them work together, one with a good record at Criminal Defense and one with a good record at immigration law.

I don't mean to offend, but he should have known better than to buy that gun.

Get a lawyer and cooperate.

If he's clean and thats his only mistake, he might be able to get through this with the help of a lawyer.

There probably isn't much else you can do.

They are pretty strict these days on immigration and guns. Who knows what interpretation of the law they can use against him.

You definitely need a good lawyer.

Get a lawyer and see what they say. There is a reason they are keeping your husband locked up. They just can't throw him in jail for nothing, and keep him there. They would of had to question him, and release him, unless they have good enough evidence to charge him with something.
