Re-mortgage problems - Help needed!?

We are re-mortgaging at the moment and have been told by our solicitor that our name is not on the Land Registry and that they are unable to trace the previous owners (a proof of marriage was required from the lady as she signed in the wonrg name!)

The sloicitor has now said they need to do the following:-

"We now have no alternative but to issue Court proceedings to ask the Court to sign the Transfer. In addition the sellers solicitors have failed to provide the executed transfer which they are obliged to do and we will be seeking the costs of this application from that firm. I really cannot tell you how long it will take for the Court Order to be obtained but this will be dealt with as quickly as possible and we will keep you informed of developments. "

Is there anyone who has been through this? or any idea of timescale? We are so frustrated and annoyed that in 2 years since be bought the property - we had no idea about this!!

Can you ask your lenders to see if they would be happy with an undertaking from the solicitor in order to complete the re-mortgage?

If you can get this accepted, then at least you have your money and can just keep on top of your (clearly inept) solicitor to sort this out.

These things can rumble on for a long long long time I am afraid. The quickest ways I have ever seen to resolve them are to kick up a fuss so that someone sorts it out to shut you up. The people to target here are both solicitor and lender.

the 1st question is where WTF is the solicitor used to purchase this property...??? he has messed up...contact the Law society...you should not be footing the bill for this....he should have regisitered this property for you...WTF???
